Abstract

The outbreak of the COVID-19 pandemic instigated dramatic and lasting changes in the field of arbitration, a preferred mechanism for international dispute resolution. The timing of the global lockdowns forced the legal sector in every corner of the world to switch quickly from the traditional in-person hearings to the technologically-assisted ones. This study seeks to understand the future path of arbitration after the pandemic by thoroughly looking into the reform of laws, and the point where the technological efficiency meets the procedural fairness. It is crucial for the future of arbitration that the field will attract and keep the clients by offering the smoothest and quickest ways to resolve disputes while at the same time being fair and just through the strategic use of digital innovation. This paper presents the evidence that backs this thesis, outlines its wide-ranging implications for the resolution of international disputes, and suggests measures to maintain the flexibility, credibility, and integrity of arbitration in the world which is now more connected and is recovering from the pandemic.
