Abstract

Euthanasia or assisted suicide has been a matter of debate since decades. It has received mixed responses from legal experts and jurists on account of the ethical considerations involved. Consequently, several states do not recognize the Right to Die citing the principles of inviolability and sanctity of human life. The states that recognize the Right to Die, India for one, rely on principles of individual bodily autonomy and right to refuse medical treatment. Indian courts, after a series of differing judicial pronouncements, have recognized the Right to Die and have issued Advanced Medical Directives through which the right can be exercised. However, documents of international law (UDHR, ICCPR etc.) do not recognize the Right to Die as a facet of Right to Life. With an evolving society that emphasizes individual autonomy and right to self-determination, it is imperative that Right to Die is classified as a human right on international level.
